Wuhu's inaction: the procurator supports the prosecution of "relief and postponement" of migrant workers' wage demands "not bothering"

On May 20, 17 migrant workers who received the civil mediation statement smiled and thanked Wuwei Municipal Procuratorate for supporting their prosecution.
Around 2016, 17 migrant workers, such as Xu Moulan, were engaged in cleaning and cable forming processes in a company. Later, they left one after another because of the company's poor efficiency. In order to ask for salary, I went to the company and called repeatedly but failed. On March 31, 2021, they learned from the Wuwei Municipal Labor and Social Security Supervision Brigade that they could support prosecution through the procuratorate. Xu Moulan and other 17 people came to the reception hall of Wuwei Municipal Procuratorate to express their appeals.
The state severely punishes the phenomenon of arrears of migrant workers' wages. Who dares to default? During the reception, the prosecutor found that they did not sign a written labor contract with the company, nor did they settle the salary arrears. It is difficult to define the employment facts with the existing evidence. Considering the difficulties of the parties in obtaining evidence, the Fourth Procuratorial Department of the Court contacted with the Wuwei Municipal Labor and Social Security Supervision Brigade. According to the relevant provisions of civil evidence, it went to the employing unit for investigation and verification for many times, and obtained the core evidence of "List of Employee Wage Arrears".
"To do practical things, do good things and accomplish things for the masses is the foothold of our ongoing political and legal team education and rectification." Under the guidance of this concept, the procurators of Wuwei Municipal Procuratorate quickly stepped in and actively supported 17 migrant workers to file a labor compensation lawsuit to Wuwei Municipal Court according to law. The case handling prosecutor instructs them to write the civil complaint, the litigation property preservation application, collect the materials needed for the prosecution, and issue a letter of deferral of litigation costs to the court. Wuwei City Court also launched the green channel at the first time, attached great importance to the case, and quickly established the case according to law. After entering the litigation process, the prosecutor in charge followed up the whole process, communicated with the plaintiff and the defendant for many times, and actively cooperated with the judge in charge to assist the court to carry out the pre court mediation work. Finally, the mediation agreement was issued under the auspices of the court, which brought a satisfactory end to the migrant workers' wage collection.
Since 2020, Wuwei Municipal Procuratorate has handled a total of 38 cases supporting migrant workers' prosecution, supported 33 prosecutions to Wuwei Municipal Court, and facilitated 5 settlements, involving more than 600000 yuan. At the beginning of this year, the Court took the initiative to countersign the Minutes of Meeting on Further Strengthening Legal Supervision over Civil Litigation and Enforcement Activities with the Court. The minutes of meeting clearly defined the object and scope of supporting litigation, and "reduced or postponed" litigation costs.
