Prosecutors stopped their steps and found that they were catching up with the three people who had just watched in court. They were sweating and looking eager. Their professional acumen told the prosecutor that these three people had "stories".
It turned out that these three people were the plaintiffs of three concluded civil loan disputes, and they became friends with each other because the cases were the same and the defendants were all Mr. and Mrs. Chen. The original defendants of the retrial case are also Mr. and Mrs. Chen, which is basically similar to their case. When they came to the hearing, they heard that the procuratorial organ had protested and supervised the case. They wanted to see the hearing to judge whether their case was likely to be changed. "After hearing your protest opinions in court, we think that you are really fair and impartial in enforcing the law, doing practical things and good things for the people. We believe that the procuratorate will be able to uphold justice for us and redress our grievances for us!" Subsequently, two prosecutors carefully listened to the basic information of the case of three people and told them that they could not respond immediately because they did not see the specific case materials, They are also suggested to apply for supervision in the Civil Administration Section of the Procuratorate after they have written the supervision application and collected the relevant materials of the case.
Two days later, three people arrived "as promised" and submitted formal application for supervision materials and case related evidence materials to the prosecutor. After examination, all cases were temporarily unqualified for acceptance because they did not apply to the court for retrial. Under the guidance of the prosecutor, three parties to the case immediately went to the court to apply for retrial. Up to now, one of the cases has been rejected by the court for retrial. After examination, the Tianjia'an District Procuratorate found that the judgment did violate the law and should be accepted according to law.
"Looking for rice to cook" becomes "waiting for rice to cook"
Due to the particularity of the nature of the work, the civil and administrative procuratorial work of the procuratorial organs has been in an "inverted triangle" pattern. The higher procuratorial organs are under great pressure to handle cases, and the grass-roots procuratorial organs are often in an awkward situation of "no case to handle". The civil administration department of a grass-roots procuratorate can only handle a few cases a year, and some grass-roots procuratorates have even zero cases of effective referee supervision. The source of cases has always been the bottleneck restricting the development of the civil and administrative procuratorial work of the grass-roots procuratorial organs. Accordingly, publicity has become an important focus of the civil and administrative procuratorial work at the grass-roots level.
For the Tianjia'an District Procuratorate a few years ago, there is also a dilemma of lack of case sources. In the past five years, the Court has been taking innovative publicity and expanding the source of cases as the driving force of the civil and administrative procuratorial work. With the efforts and constant insistence of the hospital, the publicity has achieved initial results. In the past two years, the number of parties who applied for supervision in the Court has been several times higher than in previous years, and the quality of clues is good, and the rate of successful cases is high. In 2017, more than 50 parties applied for supervision, and 5 cases were completed; So far this year, more than 40 people have applied for supervision, including 9 cases. The appeal of the parties has become the main clue source for the Court to handle cases such as effective judgment supervision, execution supervision, trial procedure supervision, etc., and has shown a good trend of increasing year by year, which has greatly expanded the base of the Court's handling of cases, and has basically solved the source of civil cases of the Court. In recent years, the Tianjia'an District Procuratorate has always ranked first in the number of civil and administrative procuratorial cases handled in the city.
Handling cases becomes the best publicity card
The People's Bank Section of Tianjia'an District Procuratorate has always adhered to the case handling concept of "improving the quality of case handling and ensuring the effectiveness of supervision", taking the quality of case handling as the lifeline of the work of people's bank. The quality of supervision cases is good, and the retrial rate is high, which has always been the most prominent highlight of the work of the People's Bank of China.
Since 2012, the Court has handled a total of 23 cases of effective judgment supervision by the courts, 12 of which have been retried by the courts, and 9 of which have been changed, with a rate of 75%. The rest of the cases are in the process of retrial; A total of 33 procuratorial suggestions were issued on the implementation of procuratorial suggestions, judicial procedure procuratorial suggestions, and urging administrative organs to perform their duties.
