1. Whoever illegally manufactures, trades in, transports or stores tetramine and other prohibited highly toxic chemicals, endangering public security, shall, in accordance with the provisions of Article 125 of the Criminal Law, be convicted of illegally manufacturing, trading in, transporting or storing dangerous substances and sentenced to fixed-term imprisonment of not less than three years but not more than 10 years: (1) Illegally manufacturing, trading in, transporting or storing raw powder, liquid More than 50g of technical drug preparation, or more than 2kg of bait; （2） Causing serious injury, death or public or private property loss of more than 100000 yuan in the process of illegal manufacturing, trading, transportation and storage. 2. Whoever illegally manufactures, trades in, transports or stores tetramine and other prohibited highly toxic chemicals shall be sentenced to fixed-term imprisonment of not less than 10 years, life imprisonment or death under one of the following circumstances as stipulated in Article 125 of the Criminal Law: (1) Whoever illegally manufactures, buys, sells, transports or stores more than 500 grams of raw powder, liquid or preparation, or more than 20 kilograms of bait; （2） More than 3 people are seriously injured or killed, or more than 200000 yuan of public and private property losses are caused in the process of illegal manufacturing, trading, transportation and storage; （3） Illegally manufacturing, trading, transporting or storing raw powder, raw drug or preparation of more than 50g but less than 500g, or bait of more than 2kg but less than 20kg, and involving other serious circumstances. 3. Where a unit illegally manufactures, trades in, transports or stores tetramine and other prohibited highly toxic chemicals, the criteria for conviction and sentencing set forth in Articles 1 and 2 of this Interpretation shall apply. 4. If any functionary of a State organ who is responsible for investigating and dealing with the illegal manufacturing, trading, transportation, storage of tetramine and other prohibited highly toxic chemicals abuses his power or neglects his duty, resulting in heavy losses to public property and the interests of the State and the people, he shall be investigated for criminal responsibility according to the provisions of Article 3917 of the Criminal Law for the crime of abuse of power or neglect of duty.
