Required. Although criminals serve their sentences and execute their punishments, they also enjoy normal civil rights according to law. Creditors can claim the debts they owe through consultation and litigation. The plaintiff may file a lawsuit in the people's court where the plaintiff is located.
Article 985 of the Civil Code
If the beneficiary obtains improper benefits without legal basis, the person suffering losses may request the beneficiary to return the benefits obtained, except in any of the following circumstances:
（1） Payment for fulfilling moral obligation;
（2） Repayment of debts before maturity;
（3） The repayment of debts with the knowledge that there is no obligation to pay.
