On September 9, 2021, the Supreme People's Court and the Supreme People's Procuratorate announced the Judicial Interpretation on Handling Criminal Cases such as Information Network Defamation. According to the judicial interpretation, if someone uses the information network to defame others, and the same defamation information is actually clicked and viewed more than 5000 times, or forwarded more than 500 times, it shall be deemed as "serious" as stipulated in the first paragraph of Article 246 of the Criminal Law, which can constitute a crime of defamation; If the perpetrator, knowing that it is a fabricated fact that damages the reputation of others, commits an act of spreading on the information network, subjectively intentionally and objectively causes actual damage, and the circumstances are flagrant, he shall be convicted and punished for the crime of defamation. The crime of libel in Article 246 of the Criminal Law refers to the act of deliberately fabricating and spreading fabricated facts, which is enough to degrade the personality of others, damage their reputation, and the circumstances are serious. The so-called serious circumstances mainly refer to repeatedly fabricating facts to slander others; Fabricating facts to cause serious damage to the personality and reputation of others; Fabricating facts to slander others and causing adverse effects; It refers to the cases that slander others and cause them to become mentally disordered or cause the victims to commit suicide. Article 42 of the Law of the People's Republic of China on Administrative Penalties for Public Security: Whoever commits one of the following acts shall be detained for not more than five days or fined not more than 500 yuan; If the circumstances are relatively serious, they shall be detained for not less than 5 days but not more than 10 days and may be fined not more than 500 yuan: (1) Writing threatening letters or threatening the personal safety of others by other means; (2) Openly insulting others or fabricating facts to slander others; (3) Fabricating facts to falsely accuse and frame another person in an attempt to subject another person to criminal investigation or public security administration punishment;
