Article 19 of the Amendment (VI) to the Criminal Law of the People's Republic of China amends Article 312 of the Criminal Law to read: "Whoever knowingly conceals, transfers, purchases, sells for others or conceals by other means the proceeds of crime and the proceeds generated therefrom shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or public surveillance and shall also, or shall only, be fined; If the circumstances are serious, he shall be sentenced to fixed-term imprisonment of not less than three years but not more than seven years and shall also be fined. ”At the same time, the crime of harboring, transferring, purchasing and selling stolen goods was changed to the crime of covering up and concealing the proceeds of crime and the proceeds of crime.

Where a unit commits the crime mentioned in the preceding paragraph, it shall be fined, and the persons who are directly in charge and the other persons who are directly responsible for the crime shall be punished in accordance with the provisions of the preceding paragraph. Article 3 of the Interpretation of the Supreme People's Court on Several Issues Concerning the Application of Law in the Trial of Criminal Cases of Covering up or Concealing the Proceeds from Crime and the Proceeds from Crime shall be deemed as "serious" in the first paragraph of Article 312 of the Criminal Law if one of the following circumstances occurs: (1) Covering up Concealing the value of the proceeds of crime and the proceeds generated therefrom, amounting to more than 100000 yuan; （2） Covering up or concealing the proceeds of crime and the proceeds thereof for more than ten times, or for more than three times with a total value of more than 50000 yuan; （3） The concealed or concealed proceeds of crime are electric power equipment, transportation facilities, radio and television facilities, public telecommunications facilities, military facilities, or funds and materials for disaster relief, emergency rescue, flood control, preferential treatment, poverty alleviation, immigration, and relief, with a total value of more than 50000 yuan; （4） The act of concealing or concealing causes that the upstream crime cannot be investigated and dealt with in a timely manner, and causes irreparable loss of public or private property or other serious consequences; （5） Committing other acts of concealing and covering up the proceeds of crime and the proceeds generated thereby, which seriously hinders the judicial organ from investigating the upstream crime.
