The State Administration of Market Supervision introduced that the Regulations on the Review of Fair Competition for the first time made comprehensive, systematic and detailed provisions on the object, standard, mechanism, supervision and guarantee of fair competition review in the form of administrative regulations, filling the legislative gap of the fair competition review system, marking that China has basically formed a relatively complete content with Chinese characteristics, with the anti-monopoly law as the core A relatively sound anti-monopoly legal system.
With regard to the special role of the Fair Competition Review Regulations in the entire anti-monopoly legal system, it is mainly to prevent government departments from introducing policies and measures to eliminate and restrict competition. Centering on the word "prevention", the Regulations have made a series of institutional arrangements to maximize the effect of prevention.
First, adhere to the principle of "pay as much as possible" and "review as much as possible". The Regulations include all policies and measures related to the economic activities of operators, including laws, administrative regulations, local regulations, rules, normative documents and specific policies and measures, into the scope of fair competition review, which reflects a kind of self-restraint, self supervision and initiative of government departments in maintaining fair competition market order.
Second, adhere to precise positioning and source control. The Regulations define fair competition review as the drafting link of formulating relevant policies and measures, and can include laws and local regulations submitted by the government to the people's congress at the same level and its standing committee for deliberation. At the same time, except for the exceptional circumstances specified in Article 12 of the Regulations, those who have not gone through the fair competition review or are not in conformity with the Regulations after the fair competition review shall not be introduced, which strengthens the rigid constraints of the system.
The third is to stick to the real case and see the real chapter. The Regulations set up targeted supervision and handling measures and assessment and evaluation mechanisms to ensure that the review of fair competition can be supervised, inspected and held accountable. The supervision measures include spot check, complaint handling, supervision, etc. The handling measures include interview, punishment, etc., especially the special provisions that "the State Council regularly supervises the construction of the fair competition review mechanism, the implementation of fair competition review, the handling of reports, etc. of the local people's governments at or above the county level", and urges all regions to pay more attention to the fair competition review, Vigorously enhance the authority and rigid constraints of the fair competition review system.
