Fuzhou Evening News recently, the Mawei Court's Mediation and Rapid Adjudication Center found that the plaintiff's husband had committed domestic violence during the trial of a divorce dispute case, so according to the woman's application, the first personal safety protection order of this year was issued in accordance with the law, providing judicial protection to women threatened by domestic violence and "showing the sword" to domestic violence.

The woman Xiaoying (not her real name) said that she married in 2000, but since 2013, she has been abused and beaten by her husband Wang for a long time, but because of her weak personality, she has not called the police. Since August 2023, in order to achieve the purpose of divorce, Wang has repeatedly come to Xiaoying's residence to make trouble, destroy the door lock of the bedroom, and repeatedly committed domestic violence against Xiaoying. Xiaoying finally chose to call the police for help. But Wang continued to threaten, harass and abuse Xiao Ying. In order to ensure her own safety, Xiaoying applied to the Mawei District Court for a writ of habeas corpus according to law.

After examination, the presiding judge believes that according to the evidence materials provided by the woman Xiaoying and the court investigation of the divorce proceedings of both parties, it can be proved that Xiaoying has suffered from domestic violence or is in real danger of domestic violence, and Xiaoying's application meets the legal conditions of the personal safety order. Therefore, in accordance with the relevant provisions of the Anti Domestic Violence Law of the People's Republic of China, the respondent Wang is prohibited from committing domestic violence against the applicant Xiao Ying; The ruling prohibiting the respondent Wang Mou from threatening, tracking and harassing the applicant Xiao Ying.

After the issuance of the personal safety protection order, if the respondent Wang violates the above injunction, the court will impose a fine or detention depending on the seriousness of the case; If a crime is constituted, criminal responsibility shall be investigated according to law.
