1、 Active disclosure

(1) Scope of disclosure

In accordance with the provisions of Articles 19 and 20 of the Regulations, the Office of the Education Department of Zhejiang Province actively discloses to the public government information that involves the vital interests of the masses, needs to be widely known by the masses or needs public participation in decision-making, as well as information that should be actively disclosed in accordance with laws, regulations, rules and relevant national regulations, and in accordance with the deployment of higher administrative organs, Continuously increase the active disclosure of content in combination with practical work.

(2) Public directory

1. Organization overview, organization functions, leadership information, introduction of departments and directly affiliated units, and working rules;

2. Personnel management;

3. Annual report of information disclosure website work, government information disclosure guide, and annual report of information disclosure work;

4. Financial budget and final accounts;

5. Work dynamics;

6. Planning, major decisions and plan summary;

7. The system and announcement of the province's annual statistical announcement of education funds, the statistical bulletin and statistical data of education development, education fees, special funds, the province's school information table, education supervision, and the list of random checks;

(3) Publicity

The government information actively disclosed by Zhejiang Provincial Department of Education will go through the portal website of our department( http://jyt.zj.gov.cn )Zhejiang Government Affairs Service Network( http://www.zjzwfw.gov.cn )Open to the public. (4) Disclosure time limit

Government information that falls within the scope of active disclosure shall be disclosed within 20 working days from the date of formation or change of the information. If laws and regulations provide otherwise for the period of government information disclosure, such provisions shall prevail.  

(5) Arrangement system.

The "active public information" released by the Provincial Department of Education includes index number, document number, information name, content overview, publishing agency, generation date, subject classification, publicity method, etc.

2、 Open upon application

When this authority provides government information according to the application, it shall provide the information according to the actual state of the information, excluding the information that needs to be summarized, analyzed, processed or otherwise processed.

(1) Acceptance institution

The Office of the Education Department of Zhejiang Province, as an acceptance institution for disclosure of applications, shall, in accordance with the relevant provisions of the Regulations, respond to the government information applied for by citizens, legal persons or other organizations in accordance with the law.

(2) Application

If the applicant applies by means of on-site, letter and fax, he/she should fill in the written Application Form for Government Information Disclosure of Zhejiang Provincial Education Department (hereinafter referred to as the "Application Form"), which can be obtained at the place of acceptance or copied by himself/herself or from the portal website of Zhejiang Provincial Education Department( http://jyt.zj.gov.cn )Download printing.

If the applicant applies online, he/she must fill in the Application Form online as prompted and submit the application. Applicants must pass the real name authentication of the website when submitting online applications. After the application is submitted successfully, you can use the number and password fed back by the system to query the acceptance on the government information disclosure platform of the portal website of Zhejiang Provincial People's Government.

(3) Application method

Citizens, legal persons or other organizations that obtain government information from this organ may apply in the following ways:

1. Site application. The applicant can submit a written application at the information disclosure acceptance point of the Provincial Education Department. If it is really difficult to apply in written form, the applicant may make an oral request, and the acceptor shall fill in the application for government information disclosure on behalf of the applicant.

2. Letter application. The applicant can apply to the provincial education department office by letter, fax and other means, and should indicate the words "government information disclosure application" in the lower left corner of the envelope or in the obvious position of the fax.

(4) Acceptance procedure

After receiving the application for government information disclosure, this organ shall register and handle it in a timely manner. If a reply can be made on the spot, it shall be made on the spot; If it is unable to reply on the spot, it shall reply within 20 working days from the date of receiving the application; If it is necessary to extend the time limit for reply, with the consent of the leader in charge of government information disclosure work of this organ, the applicant shall be informed that the time limit for extension of reply shall not exceed 20 working days; If the content of the application submitted by the applicant is not clear or the application does not meet the specified requirements, the application shall be received as of the date of receipt seven The applicant shall be informed to make corrections in a lump sum within working days, stating the items that need to be corrected and the reasonable deadline for correction. The time limit for reply shall be calculated from the date when this organ receives the application for correction. If the applicant fails to make corrections within the time limit without justified reasons, it shall be deemed as giving up the application, and this organ will no longer process the application for government information disclosure; If the government information involves the rights and interests of a third party, this organ needs to seek the opinions of the third party, and the third party shall put forward opinions within 15 working days from the date of receiving the request for opinions. If the third party fails to make comments within the time limit, the administrative organ shall decide whether to make it public in accordance with the provisions of these Regulations. The details are as follows:

1. If the information applied for public has been actively disclosed, inform the applicant of the way and way to obtain the government information;

2. If the information applied for publication can be disclosed, provide the applicant with the government information, or inform the applicant of the way, way and time to obtain the government information;

3. If the administrative organ decides not to disclose the information in accordance with the provisions of these Regulations, it shall inform the applicant not to disclose the information and explain the reasons;

4. If there is no public information applied for after searching, inform the applicant that the government information does not exist;

5. If the information applied for disclosure is not the responsibility of this administrative organ, inform the applicant and explain the reasons; If it is possible to determine the administrative organ responsible for disclosing the government information, the applicant shall be informed of the name and contact information of the administrative organ;

6. If the administrative organ has replied to the applicant's application for the disclosure of government information, and the applicant repeatedly applies for the disclosure of the same government information, it shall inform the applicant not to deal with it repeatedly;

7. The information applied for publication belongs to industrial and commercial, real estate registration data and other information. If relevant laws and administrative regulations have special provisions on the acquisition of information, the applicant shall be informed to handle in accordance with the provisions of relevant laws and administrative regulations.

8. If the information applied for disclosure contains content that should not be disclosed or does not belong to government information, but can be handled differently, the administrative organ shall provide the applicant with the content of government information that can be disclosed, and explain the reasons for the content that should not be disclosed.

9. If the number and frequency of the applicant's application for disclosing government information obviously exceed the reasonable range, the administrative organ may require the applicant to explain the reason. If the administrative organ considers the reasons for the application unreasonable, it shall inform the applicant not to handle it; If the administrative organ considers that the reasons for the application are reasonable, but is unable to reply to the applicant within the prescribed time limit, it may determine a reasonable time limit for delaying the reply and inform the applicant.

(5) Charging situation

This authority provides government information upon application without charge. However, if the amount and frequency of the applicant's application for the disclosure of government information obviously exceed a reasonable range, this organ may charge an information processing fee. The charging standard shall comply with the information processing charging method formulated by the relevant national department.

3、 Non disclosure scope

1. Government information that is determined as a state secret according to law, government information prohibited from disclosure by laws and administrative regulations, and government information that may endanger national security, public security, economic security, and social stability after disclosure shall not be disclosed.  

2. Government information involving trade secrets, personal privacy and other public information that will cause damage to the legitimate rights and interests of third parties shall not be disclosed by this organ. However, if the third party agrees to make it public or this organ believes that not making it public will have a significant impact on public interests, it shall make it public.

3. The internal affairs information of the organ, including personnel management, logistics management, internal workflow and other information, shall not be disclosed.

4. The discussion records, process drafts, consultation letters, request reports and other process information as well as the administrative law enforcement file information formed in the process of performing the administrative management functions of this organ shall not be disclosed. Where laws, regulations and rules stipulate that the above information shall be disclosed, such provisions shall prevail.

4、 Supervision and guarantee

Citizens, legal persons or other organizations may complain or report to the administrative organ at the next higher level if they believe that their own organs have not fulfilled the obligation of disclosing government information according to law. In accordance with the Guiding Opinions of the General Office of the People's Government of Zhejiang Province on Building a Unified Government Affairs Consultation, Complaint and Reporting Platform (ZZBF [2015] No. 127), complaints and reports can also be made on the "Unified Government Affairs Consultation, Complaint and Reporting Platform" of Zhejiang Government Affairs Service Network.

Citizens, legal persons or other organizations may apply for administrative reconsideration or bring an administrative lawsuit according to law if they believe that their specific administrative act in the work of government information disclosure infringes their legitimate rights and interests. That is, you can apply for administrative reconsideration to the People's Government of Zhejiang Province in accordance with the law within 60 days from the date of receiving the reply to the application for information disclosure, or file an administrative lawsuit to the People's Court in accordance with the law within 6 months from the date of receiving the reply to the application for information disclosure.
