In principle, after divorce, the joint property of the husband and wife shall be shared equally, and the property of the husband and wife before marriage shall belong to each other. If both parties have an agreement on the division of property, the property shall be divided according to the agreement of both parties. Article 19 of the Marriage Law stipulates that the husband and wife may agree that the property acquired during the marriage relationship and the pre marital property shall belong to their own ownership, joint ownership or part of their own ownership or part of their joint ownership. The agreement shall be in writing. In the absence of an agreement or an unclear agreement, the provisions of Articles 17 and 18 of this Law shall apply. If both parties have an agreement on the ownership of the custody of the child, the custody of the child shall be determined in accordance with the agreement. If there is no agreement or no consensus can be reached on the custody of the child, a lawsuit can be filed to the court to determine the ownership of the custody.
