When the husband and wife agree to divorce, they need to prepare the household register, ID card, marriage certificate and the divorce agreement signed by both parties to apply for divorce registration at the marriage registration authority where one party's household is located. After examination, the marriage registration administration authority will register the divorce application that conforms to the Marriage Law and the Regulations on the Administration of Marriage Registration and issue the Divorce Certificate, Cancel the Marriage Certificate. The party concerned shall terminate the husband and wife relationship from the date of obtaining the divorce certificate. The legal basis is: Article 4 of the Marriage Registration Ordinance, when mainland residents get married, both men and women should go to the marriage registration office of one party's permanent residence to register their marriage. If a Chinese citizen marries a foreigner in the mainland of China, or a mainland resident marries a Hong Kong resident, a Macao resident, a Taiwan resident, or an overseas Chinese in the mainland of China, both men and women shall jointly go to the marriage registration office in the place where the mainland resident's permanent residence is located to register their marriage. Article 5 Mainland residents who apply for marriage registration shall present the following certificates and supporting materials:
 （1） My household register and ID card;
 （2） A signed statement that I have no spouse and no direct blood relationship or collateral blood relationship within three generations with the other party. Hong Kong residents, Macao residents and Taiwan residents who have gone through marriage registration shall present the following certificates and supporting materials:
 （1） My valid pass and ID card;
 （2） The statement that I have no spouse and no direct blood relationship with the other party or collateral blood relationship within three generations notarized by the notary office of my residence.
