This is the relevant provisions of the Zhengzhou Municipal Regulations on Smoking Prohibition in Public Places, implemented on September 1, 1998. After 22 years, the Regulations of Zhengzhou on the Prohibition of Smoking in Public Places (hereinafter referred to as the "Regulations") finally ushered in the revision and was officially implemented on August 5. According to the relevant person in charge of the Zhengzhou Municipal Health Commission (Love Health Office), the scope of non-smoking areas, law enforcement subjects, punishment amount and other relevant contents involved in the previous Regulations have not adapted to the development of the situation and the requirements of laws and regulations, and cannot meet the purpose of protecting people from the harm of tobacco smoke.
It is understood that the new version of the Regulations stipulates that the public places where smoking is prohibited in outdoor areas include: (1) nurseries, kindergartens, primary and secondary schools, children's palaces, education and training institutions and other places that mainly provide education, teaching, activities and services for minors; （2） Outdoor teaching areas of schools and training institutions other than those specified in the first paragraph; （3） Maternal and child health care centers, children's hospitals and other medical and health institutions and child welfare institutions that mainly provide services for women and children; （4） Outdoor audience seats and competition, fitness and performance areas in sports and fitness venues and performance venues; （5） Cultural relics protection units open to the public; （6） Other public places specified by laws and regulations.
The new version of the Regulations stipulates that individuals who find smoking in places where smoking is prohibited can dissuade smokers from smoking; Require the operators and managers of the place to dissuade smokers from smoking; Or call Zhengzhou 12320 Health Hotline to report complaints.
If the unit in a public place where smoking is prohibited violates the Regulations and causes repeated smoking in the public place, it shall be warned and ordered to make corrections within a time limit; If it fails to make corrections within the time limit, it shall be fined not less than 1000 yuan but not more than 3000 yuan. Individuals who smoke in prohibited areas in violation of the provisions of these Regulations shall be ordered by the municipal or district administrative departments of health to make corrections immediately and may be fined 50 yuan; If he refuses to make corrections, he shall be fined 200 yuan. Those who refuse or obstruct law enforcement personnel or inspectors from performing their official duties according to law shall be punished by the public security organ in accordance with the Law of the People's Republic of China on Administrative Penalties for Public Security; If a crime is constituted, criminal responsibility shall be investigated according to law.
For minors smoking, the new version of the Regulations also makes detailed provisions: it is prohibited to sell tobacco products to minors. If it is difficult to determine whether or not they are adults, business operators shall require them to show their identity documents; No tobacco products may be sold to those who cannot show their identity cards. A business operator shall set up a sign at a prominent position in its business premises that smoking is harmful to health and that tobacco products are not sold to minors.
According to the relevant person in charge of Zhengzhou Municipal Health Commission, this revision will play a positive role in controlling second-hand smoke exposure in public places, improving the level of smoke control management in public places, and play a demonstration and promotion role in the national and provincial tobacco control work.
