According to Article 20 of the Administrative Measures of Shenzhen Municipality on the Occupation of Excavated Roads (SFBG [2020] No. 5), in any of the following circumstances, the application for occupation of excavated roads shall not be permitted according to law:

（1） In violation of the provisions of the Administrative Measures of Shenzhen City on Urban Roads, digging urban roads that have not been delivered for use for 5 years after new construction, expansion or reconstruction, or less than 3 years after the completion of major repair, or breaking through the main roads that have more than six lanes in both directions;

（2） In violation of the Administrative Measures of Shenzhen Municipality on Underground Utility Tunnel (for Trial Implementation), laying pipelines of the same kind on the roads with existing underground utility tunnels;

（3） Setting the same type of members on the road of the built multi-functional member;

（4） The submitted application materials for occupation of excavated roads do not meet the requirements;

（5） The project construction unit is listed as the object of joint punishment for dishonesty;

（6） Other cases that are not allowed according to laws, regulations and rules.

Under the circumstances listed in the first paragraph of the preceding paragraph, if it is necessary to occupy the excavated road due to special circumstances such as provincial and municipal key construction projects, the applicant shall submit relevant certification materials to the municipal transportation administration department that it is really necessary to occupy the excavated road, and the municipal transportation administration department shall report to the municipal government for approval within 5 working days from the date of receiving the application. The time required by the municipal government for examination and approval shall not be included in the time limit for handling the permit.
