Measures of Fuzhou Municipality on the Protection and Management of Historical and Cultural Blocks

general provisions

Article 1 In order to further improve the comprehensive management level of the historical and cultural blocks in our city, these measures are formulated in accordance with the relevant provisions of the Regulations on the Protection of Famous Historic and Cultural Cities, Towns and Villages, the Regulations on the Protection of Famous Historic and Cultural Cities, Towns, Villages and Traditional Villages in Fujian Province, the Regulations on the Protection of Famous Historic and Cultural Cities, Towns and Traditional Villages in Fuzhou City, and in combination with the actual situation of the historical and cultural blocks in this city.

Article 2 The historical and cultural blocks mentioned in these Measures refer to the historical and cultural blocks, including three lanes and seven alleys, Zhu Zifang, Shangxiahang and other historical and cultural blocks in the four urban areas determined in the protection plan of Fuzhou's famous historical and cultural city. The protection scope includes the core protection scope and the construction control zone.

Article 3 The management of historical and cultural districts shall follow the principle of "coordinated promotion at the municipal level, unified management at the territorial level, coordination and efficient cooperation, and joint governance, construction and sharing", protect the authenticity of historical relics, maintain the integrity of street style, maintain the continuity of urban context, and correctly handle the relationship between protection and development.

Article 4 The historic and cultural blocks shall take the revival of the historic city as the guide, adopt the management methods of guidance, renewal and governance, highlight the protection and utilization of the historic and cultural blocks, cultural relics, historical buildings, traditional buildings and other protection elements, and make the international cultural brand of Fujian Capital known.

Chapter II Management Mechanism

Article 5 Adjust and enrich the leading group for the protection and construction of the city's famous historical and cultural cities, with the main leader of the municipal party committee as the group leader, the main leader of the municipal government as the first deputy group leader, the relevant leaders of the municipal party committee and the municipal government as the deputy group leader, the relevant municipal units and territorial governments as members, and the leading group office is located in the city's famous historical and cultural city protection and management organization, We will comprehensively promote the protection, construction and management of historical and cultural neighborhoods.

Article 6 The relevant competent departments directly under the municipal government shall jointly do a good job in the protection and management of historical and cultural blocks according to the following division of labor:

(1) The Municipal Administration for the Protection of Historic and Cultural Cities is responsible for coordinating the protection and utilization of historical and cultural blocks, preparing special protection plans and business type plans for historical and cultural blocks, incorporating the operation and management of historical and cultural blocks into the evaluation mechanism of famous cities, and urging all functional departments and local governments to perform the responsibility of block protection and management.

(2) The municipal cultural relics department is responsible for regulating the protection and utilization of cultural relics in the historical and cultural blocks, focusing on the supervision of the activation and utilization of cultural relics protection units and celebrities' former residences at the municipal level and above; Organize and carry out special inspection; Urge and guide the district cultural relics department to do a good job in the daily management of cultural relics protection units and other cultural relics buildings.

(3) The municipal department in charge of culture and tourism is responsible for strengthening the cultural and tourism promotion of the historical and cultural blocks, guiding the blocks to hold special cultural and tourism activities, and creating immersive business and new consumption scenes in the scenic spot; Develop cultural tourism iterative products with strong experience and high participation, reasonably optimize tour routes, further improve tourism supporting facilities, and achieve upgrading of blocks.

(4) The municipal competent department of commerce is responsible for increasing the support for time-honored brands in historical and cultural blocks, innovating new business models in historical and cultural blocks, and supporting the introduction of characteristic consumer brands that conform to the positioning of business types in historical and cultural blocks; Cooperate with the promotion of digital RMB and other convenient payments.

(5) The municipal competent department of urban and rural construction shall examine, approve, supervise and manage the block construction projects according to law. Urge the fuel gas operating enterprises to guide fuel gas users to use fuel gas safely, and regularly carry out safety inspection of fuel gas facilities.

(6) The municipal competent department of resource planning is responsible for the allocation and transfer of the use right of state-owned construction land within the scope of historical and cultural blocks, issuing "one document and two certificates" according to the application of the construction unit, and cooperating with relevant competent departments to prepare special plans for the protection of historical and cultural blocks and cultural heritage protection.

(7) The municipal state-owned assets supervision department is responsible for implementing differentiated assessment on the operation units of the blocks, strengthening the assessment on the protection effectiveness of historical and cultural blocks based on the setting of assessment indicators for the preservation and appreciation of state-owned assets, and guiding enterprises to protect and utilize the assets of historical and cultural blocks in accordance with the requirements of the cultural relics department and the block management organization.

(8) The municipal market supervision and administration department shall inform the operators in the block to comply with the requirements of the block's prohibition on introducing business types and relevant regulations when handling business licenses, and the operators shall sign a letter of commitment; Organize the investigation and punishment of the operation without business license in the street according to law.

(9) The municipal fire rescue institution shall perform the responsibility of comprehensive fire safety supervision according to law, formulate the fire emergency rescue plan of the block and key units in the block, organize drills regularly, and be responsible for organizing and directing fire fighting in case of fire; Take the lead in the investigation and handling of fire accidents, and promote the fire safety management of historical and cultural blocks; Carry out fire control supervision and inspection, and investigate and deal with violations of fire safety management regulations according to law.

(10) Relevant municipal competent departments such as urban management, finance and public security should strengthen the division of labor and cooperation, protect and manage historical and cultural blocks according to their respective responsibilities, and jointly promote the overall improvement of the management efficiency of historical and cultural blocks.

Article 7 The historical and cultural districts shall be subject to territorial management. The local people's government shall set up a district management organization to take overall responsibility for the daily protection and management of the district city management, fire safety, social security, traffic order, lease operation, business type control, etc., and strengthen the patrol management of the districts.

Article 8 The operating unit of the historical and cultural district shall be responsible for the operation and management of the state-owned real estate in the district, carry out the daily protection and management of the district, and accept the supervision of the district management organization.

Article 9 The owners, managers and users of the real estate in the historical and cultural blocks shall strictly abide by the regulations on the protection of cultural relics and the management of historical and cultural blocks, be responsible for building repair, and implement the main responsibility for fire safety. The use of buildings should conform to the functional orientation of the protection planning of historical and cultural blocks, and at the same time conform to the business planning of historical and cultural blocks.

Article 10 Carry forward the "Maple Bridge Experience" of grassroots governance, organize community party organizations, neighborhood committees, grid members, residents' backbones, volunteer teams, industry associations and other social forces, gradually explore the establishment of a management platform for public participation, form a management mechanism of joint construction, joint governance and sharing, improve the efficiency of consultation, and play the role of social supervision.

Chapter III Urban Administration

Article 11 The management organization of the street district shall manage the external facilities such as outdoor advertisements, floodlighting, air conditioners, sunshades (rain shelters) in the historical and cultural blocks to ensure that they are in harmony with the overall style and features of the historical and cultural blocks.

Article 12 The stacking of construction materials and garbage in historical and cultural districts shall be managed in a standardized way.

Article 13 Civilized air drying is advocated in the historical and cultural blocks, and it is forbidden to air objects that hinder the appearance of the city along the main street and lanes.

Article 14 All motor vehicles and non motor vehicles that need to enter the historical and cultural blocks shall be parked in the specified parking places. The district management organization can put forward the demand, and the traffic management department of the municipal public security organ will implement the time limited regional management of motor vehicles and non motor vehicles according to the actual situation of the historical and cultural districts.

During holidays and major activities, the street management organization can, according to the actual situation, request the traffic management department of the municipal public security organ to implement the time limit and traffic restriction management on the roads around the historical and cultural streets. Encourage sharing of parking resources, and support operators and property rights units to open parking facilities to the public on the premise of strengthening safety management.

Article 15 All relevant units shall regularly carry out daily inspection and maintenance of various public facilities, municipal facilities and ancillary facilities, sanitation infrastructure, greening, etc. in the historical and cultural blocks, such as municipal administration, road administration, river courses, lighting, fire fighting, etc.

Article 16 Units and individuals engaged in production and business activities shall establish and improve safety systems according to regulations, strengthen safety management and eliminate potential safety hazards in a timely manner. Encourage and support units and individuals engaged in production and business activities to use safe and environmentally friendly energy such as electric energy. The block management organization and the operation unit of historical and cultural blocks shall do a good job in work safety according to their respective responsibilities.

Article 17 The street management organizations and production and business units shall, in accordance with their respective responsibilities and the provisions of relevant laws, regulations, rules, etc., and in combination with the actual situation of the historical and cultural blocks, strengthen source control, strengthen hidden danger management, formulate emergency plans for emergencies and regularly organize relevant drills. In case of emergency, emergency measures shall be taken in time.

Article 18 The following acts affecting public security, social order, city appearance and environmental sanitation are prohibited in historical and cultural districts:

(1) Unauthorized construction or open construction;

(2) Setting up or occupying public areas as private land or business premises without authorization;

(3) Graffiti, random posting, littering and other things that affect the appearance of the street, damage scenic facilities, and damage protected buildings;

(4) Activities that affect fire rescue or increase fire risk;

(5) Other prohibited acts as prescribed by laws, regulations and rules.

Article 19 Where large-scale mass gathering activities such as sports competitions, folk custom cruises and lantern parties are held in the historical and cultural street blocks, the approval authority shall solicit the opinions of the district administrative agencies before making the decision on approval.

Article 20 If the historical and cultural blocks and the historical buildings and traditional buildings in the blocks cannot meet the fire technical standards due to the objective conditions, the preparation of fire safety guarantee scheme shall be standardized in accordance with the city's historical and cultural block fire design guidelines. The safety protection works such as technical protection, fire protection and lightning protection of cultural relics in the historical and cultural blocks shall be reviewed by the competent cultural relics department according to relevant regulations. The fire protection design of the updated buildings in the historical and cultural blocks shall be reviewed by the competent construction department according to law.

Chapter IV Operation Control

Article 21 The Municipal Administration for the Protection of Historic and Cultural Cities shall take the lead in organizing the preparation of the planning of the business types of historical and cultural blocks, put forward suggestions on the introduction and prohibition of business types, and guide the introduction of high-quality business types. After soliciting opinions from relevant departments such as cultural relics and performing procedures such as expert argumentation and publicity, the planning of business types of historical and cultural blocks shall be submitted to the municipal people's government for approval and implementation.

When soliciting opinions from relevant departments on the draft of business type planning, each department shall strictly check the planning according to its own responsibilities. The municipal administrative department of cultural relics shall screen the immovable cultural relics in the block in accordance with the cultural heritage protection plan, and further clarify the use functions before incorporating them into the business planning.

Article 22 The operation unit of the street district shall reasonably activate and utilize the cultural resources of the street district, carry out the exhibition of "intangible cultural heritage", introduce the business formats that are conducive to the protection and inheritance of historical culture, promote the integrated development of culture and tourism, and promote the creative transformation and innovative development of the culture of the capital of Fujian.

Article 23 Neighborhood operation units shall regularly conduct self-examination on the use functions and business types of cultural relics under their management, establish a dynamic evaluation mechanism for operation, and strengthen the supervision of contract performance. The use of state-owned real estate in historical and cultural blocks shall be strictly standardized, and state-owned real estate shall not be used as high-end entertainment places. The block operating unit shall urge the operating entity to implement the opening time and opening proportion specified in the contract, and the opening proportion shall not be less than 80% of the total construction area of the contract. The area of the unopened part shall not exceed 200 ㎡, and in principle, it shall be used as an office and equipment storage place.

Article 24 The business entity shall establish the awareness of civilized business operation, abide by professional ethics, consciously maintain the business type planning, operate in compliance with the law, conduct business in a civilized manner, and provide honest services, encourage the creation of business characteristics and service brands.

Article 25 Under the condition of meeting the functional orientation of the protection planning of historical and cultural blocks, the block management institutions shall promote the block operation units to fully explore the traditional culture and historical accumulation of historical and cultural blocks.

Article 26 The following illegal business operations are prohibited in historical and cultural districts:

(1) Operating without license;

(2) Illegal operation, operation or display of goods on the road;

(3) Setting up stalls and selling goods without approval;

(4) Distributing printed matter without approval;

(5) Scalping valuable tickets and vouchers;

(6) Selling invalid or deteriorated products, or selling products that are adulterated or adulterated, passing fake products off as genuine, shoddy products off as good, or passing substandard products off as qualified products;

(7) The use of loudspeakers or other methods of continuous and repeated high noise for advertising in commercial activities;

(8) Forcing consumers to purchase or use commodities or accept services;

(9) Other business activities prohibited by laws, regulations and rules.

Article 27 The business entities engaged in food processing and catering services in the historical and cultural districts shall strictly abide by the relevant provisions on food safety and production safety, and operate in the specified locations and within the permitted scope.

The business entity shall install lampblack purification facilities or take other purification measures to make the lampblack discharge meet the standard, and shall not discharge sewage in violation of regulations to prevent pollution to the environment of historical and cultural streets.

Chapter V Supervision Mechanism

Article 28 The municipal and district departments in charge of cultural relics shall carry out special inspections on the protection and utilization of cultural relics in historical and cultural districts, establish lists of problems, and implement closed-loop management of cancellation of registration numbers.

The municipal and district competent cultural relics departments and block operation units shall review the use of cultural relics buildings. For those that do not meet the requirements for the protection and use of cultural relics, the user shall be urged to stop using immediately and make rectification within a time limit. If the user fails to make rectification within the time limit, the operator shall be urged to terminate the agreement, take back the property, and punish according to law.

Article 29 Relevant acts that violate the provisions on the protection of historical buildings and buildings with traditional features shall be handled by the Municipal Administration for the Protection of Historic and Cultural Cities according to law.

Article 30 Any act that disturbs public order, impairs public security and other acts that impair social management and are harmful to society shall be subject to administrative punishment by the public security organ according to law, and criminal responsibility shall be investigated according to law if the act constitutes a crime.

Article 31 The traffic management department of the local public security organ and the district city management department shall deal with the violations of the regulations on vehicle passing and parking according to law.

Article 32 Illegal acts in the fields of city appearance and sanitation, municipal administration and other fields, as well as illegal construction identified by the district resource planning department, shall be dealt with by the district city administration department according to law.

Article 33 Illegal acts in the fields of food safety, measurement, special equipment, etc. shall be handled by the district market supervision and administration department according to law.

Article 34 The relevant functional departments shall deal with the illegal acts in urban and rural construction, environmental protection, intellectual property and other fields on their own.

Article 35 The state-owned real estate operating unit of the historical and cultural block shall sign a contract according to the block business type planning, supervise the business type of the user, terminate the contract in advance, confiscate the deposit and recover the house property if it changes the business type agreed in the contract without authorization during the lease period.

Chapter VI Supplementary Provisions

Article 36 These Measures shall come into force as of the date of promulgation and shall be valid for five years.

Article 37 The historical and cultural blocks outside the four urban areas can be implemented by reference.
