The Provisions on the Administration of Food Labeling, which were deliberated and adopted at the executive meeting of the General Administration of Quality Supervision, Inspection and Quarantine of the People's Republic of China on July 24, 2007, are hereby promulgated and shall come into force as of September 1, 2008. The Provisions on the Investigation and Treatment of Food Labeling Violations promulgated by the former State Bureau of Technical Supervision shall be repealed at the same time.

Regulations on Food Labeling Management

*Chapter General

*Article In order to strengthen the supervision and administration of food labeling, standardize the labeling of food labeling, prevent quality fraud, and protect the legitimate rights and interests of enterprises and consumers, according to the Product Quality Law of the People's Republic of China, the Food Hygiene Law of the People's Republic of China, and the Special Provisions of the State Council on Strengthening the Safety Supervision and Administration of Food and Other Products And the Regulations of the People's Republic of China on the Administration of Production Licenses for Industrial Products.

Article 2 These Provisions shall apply to the labeling and management of food produced (including repackaged) and sold within the territory of the People's Republic of China.

Article 3 The term "food label" as mentioned in these Provisions refers to the general term of words, symbols, numbers, patterns and other descriptions pasted, printed and marked on food or its package to indicate the name, quality grade, commodity quantity, method of consumption or use, producer or seller and other relevant information of the food.

Article 4 The General Administration of Quality Supervision, Inspection and Quarantine of the People's Republic of China (hereinafter referred to as AQSIQ) is responsible for organizing the supervision and administration of food labeling throughout the country within the scope of its functions and powers.

The local quality and technical supervision departments at or above the county level shall be responsible for the supervision and administration of food labeling within their respective administrative areas within the scope of their functions and powers.

Chapter II Contents of Food Labeling

Article 5 The food or its package shall be labeled, except for the food that may not be labeled according to laws and administrative regulations.

Article 6 Food labels shall indicate the name of the food.

The food name shall indicate the true attributes of the food and meet the following requirements:

(1) Where national standards and industrial standards have provisions on food names, The name specified in national standards and industrial standards shall be adopted

(2) Where national standards and industrial standards do not stipulate the name of food, Common names or common names that will not cause misunderstanding and confusion among consumers shall be used;

(3) When labeling "new name", "strange name", "transliteration name", "brand name", "regional slang name" or "trademark name" and other names that are easy to misunderstand food properties, the same font size shall be used to label a name or a classification (category) name specified in Items (1) and (2) of this article near the indicated name;

(4) The name of a food that is physically mixed from two or more kinds of food and is uniform in appearance and difficult to separate from each other should reflect the mixing property and classification (genus) name of the food;

(5) A food made from animal or plant food with specific processing technology to imitate the individual, organ, tissue and other characteristics of other organisms shall be preceded by the words "artificial", "imitation" or "plain", and the classification (genus) name of the true attributes of the food shall be marked.

Article 7 Food labels shall indicate the origin of the food.

The place of origin of food shall be marked to the prefecture level region according to the administrative division.

Article 8 Food labeling The name and address of the producer should be marked The name and address of the producer shall be the name and address of the producer who is legally registered and able to bear the responsibility for product quality

In case of any of the following circumstances, it shall be marked in accordance with the following provisions:

(1) A company or its subsidiary that independently assumes legal liability according to law, Each name and address shall be marked

(2) The name and address of the company and its branch or production base, or only the name and address of the company, shall be marked if the branch or production base of the company cannot bear legal liability independently according to law;

(3) Those who are entrusted to produce and process food and are not responsible for external sales, The name and address of the entrusting enterprise shall be marked For the food under production license management, if the entrusting enterprise has the food production license for entrusted processing, the name and address of the entrusting enterprise and the name of the entrusted enterprise shall be marked, or only the name and address of the entrusting enterprise shall be marked;

(IV) The repackaged food shall be marked with the name and address of the repackager, and the words "repackaged" shall be indicated.

Article 9 Food labeling The production date and shelf life of food should be clearly marked

If the shelf life of the food is related to the storage conditions, the specific storage conditions of the food shall be marked. Beverage wine, vinegar, edible salt and solid sugar containing more than 10% (including 10%) ethanol can be exempted from marking the shelf life.
