Setting basis

(I) Export Control Law of the People's Republic of China (Presidential Decree No. 58 of October 17, 2020);
(II) Foreign Trade Law of the People's Republic of China (Presidential Decree No. 15 of April 6, 2004) Articles 16, 17, 18 and 19;
Article 16 The State may restrict or prohibit the import or export of relevant goods and technologies for the following reasons:
（1） It is necessary to restrict or prohibit the import or export in order to safeguard national security, social public interests or public morality;
（2） It is necessary to restrict or prohibit the import or export in order to protect human health or safety, the life or health of animals and plants, and the environment;
（3） It is necessary to restrict or prohibit the import or export of gold or silver in order to implement measures related to the import and export of gold or silver;
（4） It is necessary to restrict or prohibit the export in order to effectively protect the natural resources that may be exhausted due to the shortage of domestic supply;
（5） The export needs to be restricted due to the limited market capacity of the export countries or regions;
（6） The export business order is in serious disorder and needs to be restricted;
（7） It is necessary to restrict imports in order to establish or accelerate the establishment of a specific domestic industry;
（8） It is necessary to restrict the import of agricultural, animal husbandry and fishery products in any form;
（9） It is necessary to restrict imports in order to safeguard the country's international financial status and balance of payments;
（10） Other items that need to be restricted or prohibited from import or export in accordance with the provisions of laws and administrative regulations;
（11） According to the provisions of international treaties and agreements concluded or acceded to by China, other import or export needs to be restricted or prohibited.
Article 17 The State may take any necessary measures to safeguard national security with respect to the import and export of goods and technologies related to fissile and fusion materials or materials derived from such materials, as well as the import and export of weapons, ammunition or other military materials.
In wartime or in order to maintain international peace and security, the State may take any necessary measures in the import and export of goods and technologies.
Article 18 The department in charge of foreign trade under the State Council, together with other relevant departments under the State Council, shall, in accordance with the provisions of Articles 16 and 17 of this Law, formulate, adjust and publish a catalogue of goods and technologies whose import and export are restricted or prohibited.
The department in charge of foreign trade under the State Council, or jointly with other relevant departments under the State Council, may, with the approval of the State Council, temporarily decide to restrict or prohibit the import or export of specific goods and technologies not included in the list specified in the preceding paragraph within the scope specified in Articles 16 and 17 of this Law.
Article 19 The State shall administer the goods whose import or export is restricted by quotas, licenses, etc; The technology whose import or export is restricted shall be subject to license administration.
Goods and technologies subject to quota and license administration may be imported or exported only with the permission of the department in charge of foreign trade under the State Council or jointly with other relevant departments under the State Council in accordance with the provisions of the State Council. The State may implement tariff quota administration on some imported goods.

Acceptance conditions

（1） Application conditions
1. The export operator shall be the nuclear export monopoly unit designated by the State Council;
2. The recipient government guarantees that it will not use nuclear materials, nuclear equipment or non nuclear materials for reactors supplied by China and special fissionable materials produced through their use for any nuclear explosion purpose;
3. The recipient government guarantees to take appropriate physical protection measures for nuclear materials supplied by China and special fissionable materials produced through its use;
4. The recipient government has an effective comprehensive safeguards agreement with the International Atomic Energy Agency. This provision shall not apply to countries that have entered into voluntary safeguards agreements with the International Atomic Energy Agency;
5. The recipient guarantees that it will not transfer the nuclear materials, nuclear equipment or non nuclear materials for reactors and related technologies supplied by China to a third party without the prior written consent of the National Atomic Energy Agency of China; In case of re assignment with prior consent, the third party accepting the re assignment shall undertake the obligations equivalent to those undertaken by the Chinese direct supplier;
6. The recipient government guarantees that, without the consent of the Chinese government, it is not allowed to use the uranium enrichment facilities and technologies supplied by China or any facilities based on this technology to produce enriched uranium with a concentration of more than 20%;
7. The relevant export license application has been preliminarily approved by the National Atomic Energy Agency.

Handling method

（3） The Ministry of Commerce shall review the license application after receiving it, or review it with the Commission of Science, Technology and Industry for National Defense and other relevant departments as needed. 		Which dual-use items and technologies need to be registered for export qualification of sensitive items and technologies?
		For the export of nuclear and nuclear dual-use goods and related technologies, dual-use biological goods and related equipment and technologies, related chemicals and related equipment and technologies, missiles and related items and technologies, some dual-use items, dredgers, high-pressure water cannons, etc., the export qualification registration of sensitive items and technologies is required. 		Can the application form be different from the end user and the end use certificate?
		The application form shall be consistent with the end user and the end use description of the export items in both Chinese and English on the end use certificate.

		How to obtain the electronic certificate of Import and Export License for Dual Use Items and Technologies?
		After obtaining the electronic approval of the license on the electronic application platform for import and export control of dual-use items and technologies, the import and export operators can go to the provincial competent commerce department to obtain the electronic certificate of the Import and Export License of dual-use items and technologies by virtue of the electronic approval, and go through the import and export customs clearance and clearance procedures with the customs in a paperless manner.

		Can the consignee in the application form fill in the middleman?
		If there is an intermediary between the importer and the end user, the consignee can also fill in the intermediary, but it needs to add relevant information, or attach the trade contract signed between the intermediary and the importer, the intermediary and the end user and other relevant materials.

		Can I apply for changing the license if the customs declaration port or item price and other contents of the license change after obtaining the license?
		If it is necessary to change the non substantive contents such as the customs declaration port or item price of the license, the import and export operator shall apply for the renewal of the import and export license within the validity period of the license and provide relevant materials.

		How do export operators determine whether the items to be exported belong to dual-use items controlled by the Export Control Law?
		The export operator shall judge whether the items to be exported belong to the controlled items according to the provisions of the Export Control Law and the current regulations and the relevant announcements on export control of dual-use items. If it is really impossible to judge, it can submit a written consultation to the Ministry of Commerce to explain the technical indicators of relevant items and the reasons for the failure.

		Is it necessary to apply for import and export licenses for dual-use items and technologies if they are imported and exported between China and bonded areas, export processing zones and other areas under special customs supervision and bonded sites, or between the above-mentioned areas under customs supervision and bonded sites?

The recipient guarantees that it will not use dual-use nuclear goods and related technologies supplied by China or any copies thereof for nuclear fuel cycle activities that are not subject to IAEA safeguards. This provision shall not apply to countries that have entered into voluntary safeguards agreements with the International Atomic Energy Agency;
4. The recipient guarantees that it will not transfer dual-purpose nuclear goods and related technologies supplied by China or any copies thereof to a third party other than the declared end user without the permission of the Chinese government.
（2） Prohibitive requirements
Those that do not meet the application conditions, involve in endangering national security or the overall diplomatic situation, and do not meet the national export control policy will not be allowed.

（1） Export operators apply for import and export licenses of dual-use items and technologies, and apply for dual-use items and technology import and export control business applications (referred to as business applications, website: https://ecomp.mofcom.gov.cn ）Upload the electronic version of the application materials, and send the original of the end user and end use certificate and the application form for import and export license of dual-use items and technologies to the provincial competent commerce department (contact information is attached). （1） Application conditions
1. The recipient guarantees that the graphite items provided by China will not be used for other purposes than the declared end use without the permission of the Chinese government;
2. The recipient guarantees that the graphite items provided by China will not be transferred to a third party other than the declared end user without the permission of the Chinese government;
3. The receiving party guarantees that the graphite items provided by China will not be used for storage, processing, production and processing of weapons of mass destruction and their delivery systems.
（2） Prohibitive requirements
Those that do not meet the application conditions, involve in endangering national security and interests, and do not comply with the national export control policy shall not be allowed.
