Several Provisions on Marriage Registration between Chinese Citizens and Foreigners

(From the Marriage Registration Regulations approved and implemented by the State Council on October 1, 2003)

I If a Chinese citizen marries a foreigner in the mainland of China, or a mainland resident marries a Hong Kong resident, a Macao resident, a Taiwan resident, or an overseas Chinese in the mainland of China, both men and women shall jointly go to the marriage registration office in the place where the mainland resident's permanent residence is located to register their marriage.

2、 Chinese citizens and foreigners applying for marriage registration must hold the following certificates respectively:

(1) Mainland Chinese residents:

1. My household register and ID card;

   two . I have no spouse and no direct blood relatives with the other party

   A signed statement of collateral blood relationship.

   (2) Residents of Hong Kong, Macao and Taiwan:

   one My valid pass and ID card;

   two Statement that I have no spouse and no direct blood relationship or collateral blood relationship within three generations with the other party notarized by the notary office of my residence.

   (3) Overseas Chinese:

   one . My valid passport;

   two A certificate issued by a notary office or competent authority in the country of residence, certified by the embassy (consulate) of the People's Republic of China in that country, that I have no spouse and no direct blood relatives or collateral blood relatives within three generations with the other party, or the embassy (consulate) of the People's Republic of China in that country The certificate issued by the library that I have no spouse and no direct blood relatives or collateral blood relatives within three generations with the other party.

(4) Foreigners:

  1、 Their valid passports or other valid international travel documents;

  2、 The certificate that I have no spouse issued by the notary office or competent authority of the country where I am located and certified by the embassy (consulate) of the People's Republic of China in that country or the embassy (consulate) of that country in China, or the certificate that I have no spouse issued by the embassy (consulate) of the country where I am located.

III The marriage registration authority shall examine the certificates and certification materials issued by the parties to the marriage registration and inquire about the relevant information. If the parties meet the conditions for marriage, they shall be registered on the spot and issued a marriage certificate; If the party concerned does not meet the conditions for marriage and does not register, the reason shall be explained to the party concerned.

IV If Chinese citizens and foreigners divorce voluntarily in the mainland of China, and mainland residents divorce voluntarily with Hong Kong residents, Macao residents, Taiwan residents, and overseas Chinese in the mainland of China, both men and women should jointly go to the marriage registration authority in the place where the permanent residence of mainland residents is located to register for divorce

V The marriage registration authority shall not charge other fees or impose other obligations when handling marriage registration, except for the cost fees charged to the parties according to the charging standard
