Interpretations of the Standing Committee of the National People's Congress on Several Issues Concerning the Implementation of the Nationality Law of the People's Republic of China in the Macao Special Administrative Region

In accordance with the provisions of Article 18 and Annex III of the Basic Law of the Macao Special Administrative Region of the People's Republic of China, the Nationality Law of the People's Republic of China shall be implemented in the Macao Special Administrative Region as of December 20, 1999. Considering the historical background and reality of Macao, the implementation of the Nationality Law of the People's Republic of China in the Macao Special Administrative Region is explained as follows:

1、 All Macao residents of Chinese descent, those born in Chinese territory (including Macao), and other persons who meet the requirements for Chinese nationality under the Nationality Law of the People's Republic of China, whether they hold Portuguese travel documents or identity documents or not, are Chinese citizens.

Residents of the Macao Special Administrative Region of Chinese descent but of Portuguese descent may, at their own will, choose the nationality of the People's Republic of China or the nationality of the Portuguese Republic. Determine one nationality, that is, do not have another nationality. The above-mentioned residents of the Macao Special Administrative Region shall, before choosing their nationality, enjoy the rights prescribed in the Basic Law of the Macao Special Administrative Region, with the exception of the rights restricted by nationality.

2、 All Chinese citizens of Macao who hold Portuguese travel documents may continue to use the documents to travel to other countries or regions after the establishment of the Macao Special Administrative Region, but they shall not be entitled to Portuguese consular protection in the Macao Special Administrative Region and other regions of the People's Republic of China because they hold the above-mentioned Portuguese travel documents.

3、 Chinese citizens in the Macao Special Administrative Region who have the right of abode in foreign countries may travel to other countries or regions using the relevant documents issued by foreign governments, but they shall not enjoy the right of foreign consular protection in the Macao Special Administrative Region and other regions of the People's Republic of China because they hold the above-mentioned documents.

4、 Chinese citizens among the original Macao residents who returned to Macao from overseas before or after the establishment of the Macao Special Administrative Region may, if they change their nationality, present valid documents to the authorities in the Macao Special Administrative Region that accept nationality applications.

5、 Authorizes the Government of the Macao Special Administrative Region to designate its relevant agencies to handle all nationality applications in accordance with the Nationality Law of the People's Republic of China and the above provisions.
