Marriage registration
Notice on Applying for Marriage Registration

(The following is only a general introduction. Applicants who need to apply for a certificate should visit the website of the relevant embassies and consulates abroad or consult the consular window for details.)

1、 Marriage registration

(1) The host country recognizes the marriage registration handled by foreign embassies and consulates in that country;

(2) Both men and women applying for marriage are Chinese citizens and meet all the conditions for marriage stipulated in the Civil Code of the People's Republic of China;

(3) Both parties are Chinese citizens residing in the host country;

(4) Both parties must go to the embassy and consulate to apply voluntarily;

(5) Both parties shall submit valid passports, travel permits and residence certificates;

(6) 3 recent two inch half length bareheaded color photos of both sides;

(7) The remarried party shall submit the divorce certificate, divorce mediation statement or divorce judgment and the original of the effective certificate, and the widowed party shall submit relevant certificates;

(8) Both parties shall personally fill in and sign the Declaration of Marriage Registration Application in front of consular officers;

(9) The party concerned read out his Declaration of Application for Marriage Registration;

(10) Those who meet the conditions for marriage shall sign, stamp and get the marriage certificate on the spot at the "signature or fingerprint of the party concerned" of the Marriage Registration Review and Processing Form.

2、 Divorce registration

(1) The host country recognizes the divorce registration handled by foreign embassies and consulates in that country;

(2) Both parties to the marriage must be Chinese citizens with full civil capacity;

(3) The marriage relationship of the parties was legally concluded in the library;

(4) Both men and women must be present in person;

(5) Both parties voluntarily divorce, and reach an agreement on child rearing, property and debt treatment;

(6) Both parties shall submit valid passports, travel certificates, residence certificates and marriage certificates, as well as two two inch single recently half length bareheaded color photos of both parties and divorce agreement (in triplicate);

(7) Fill in and sign the Application for Divorce Registration in person in front of the consular officer;

(8) Within 30 days after the expiration of the divorce cooling off period, both parties shall jointly go to the embassies and consulates abroad to apply for a divorce certificate.

(9) The parties signed the divorce agreement in front of the consular officer. Each party shall hold one copy of the agreement, and the embassy or consulate shall keep one copy on file;

(10) If they meet the conditions for divorce, they shall sign their names and print their fingerprints on the "signature or fingerprint of the party concerned" in the Divorce Registration Review and Processing Form, and obtain the divorce certificate on the spot.

3、 Matters needing attention in handling marriage registration at Chinese embassies and consulates abroad

(1) In order to ensure the effectiveness of marriage registration, consular marriage registration should be recognized by the laws of the host country. Some countries do not recognize consular marriage, some countries recognize consular marriage, and others recognize consular marriage rather than consular divorce (such as Germany).

(2) The marriage certificate or divorce certificate handled by Chinese embassies and consulates abroad shall not be dismantled or altered arbitrarily. In case of problems and relevant responsibilities caused by the parties' self disassembly or alteration of the documents, the parties shall bear their own responsibilities.

(3) The validity of marriage registration handled at Chinese embassies and consulates abroad is affected by the laws and regulations of the host country. If a country adjusts the relevant laws and regulations and no longer recognizes the validity of the marriage relationship registered by foreign embassies and consulates in the country, it may affect the normal use of marriage certificates issued by foreign embassies and consulates by Chinese citizens in the local area or when applying for foreign visas.

(4) Although the Chinese embassies and consulates abroad have the same validity as the marriage registration and marriage certificates issued by the marriage registration authorities in mainland China, because the passport is a certificate for Chinese citizens to prove their nationality and identity abroad, the marriage certificates issued and used by the embassies and consulates abroad are all passport information. When a party holds a marriage certificate issued by a foreign embassy or consulate to handle domestic affairs, he is often required to provide materials proving that the marriage certificate and the domestic identity card holder are the same person. Therefore, please take your own actual situation into full consideration, such as future use needs, and properly choose to go through marriage registration procedures in the local, domestic marriage registration authorities or embassies and consulates in foreign countries. Chinese embassies and consulates abroad will also give reminders as appropriate before accepting marriage registration applications.
