Rhine consul story series: a special notarization handled in the ward

One afternoon in the midsummer of 2016, the consul consultation telephone rang. I picked up the phone and heard your faint voice: "Hello, I am a Chinese and live in Cologne. I want to entrust my domestic brother to sell my property under my name before marriage. Can the Consulate General notarize a power of attorney for me?"

The applicant is dying

"Hello! The Consulate General does not handle the notarization of entrusting others to sell domestic property in principle. If you really want to handle the notarization at the Consulate General, please prepare the following materials to come to the museum in person..." A short gasp at the end of the phone interrupted me, and I asked you with concern if you were uncomfortable. You said you were lying in bed, and the doctor told you that it was only the last few days, but you also had one wish, which was to entrust your brother to sell the house and leave the money to your mother for retirement. You asked me if I could apply for notarization of the power of attorney by mail. At that moment, I could not say "no", I know that this entrustment bears your filial piety for women; I don't know how to comfort you. Any white "lie" can't rival the cruel "honesty" of German doctors. So I said to you, take good care of yourself, let's think of other ways.

After receiving the call, the consul actively tried to find ways for the applicant

Put down the phone and I immediately reported your situation to the museum. The Consul General made a quick decision: "In case of special circumstances, please send someone to the hospital as soon as possible to apply for a permit." When I dialed your number, your German husband answered. I asked him to tell me that we would go to the hospital to apply for your certificate. Your husband said that he could not believe his ears. Please repeat it in Chinese. You were crying with joy

The next day, my colleagues and I drove to your hospital and saw you weak and thin on your bed. There was no writing desk in the ward, so we squatted in front of the bed to help you fill in the application form and the power of attorney, and witnessed your signature on the power of attorney, or perhaps your last signature in the world. So far I can't forget that your eyes were full of tears, but your mouth was full of smiles. You said that seeing us was like seeing your relatives. Your pale face was full of longing for your family.

Race against the clock to get a certificate

As it was a new museum, our museum did not have the conditions for certification at that time, and the related notaries were made on behalf of the Consulate General of the brother museum in Frankfurt. After seamless docking, the two museums have unanimously decided to resonate on the same frequency to do special things for you. Out of the hospital, we hurry to the post office and send your power of attorney to Frankfurt. I prayed silently that the pace of death would be slower, and slower; Pray for the postman to step faster and faster. The above story relates to the notarization of property disposal, which is also a topic of concern for many compatriots. Previously, Chinese citizens living abroad could apply for entrusted notarization of property related to disposal at embassies and consulates abroad. In September 2017, according to the notification requirements of the domestic competent authorities on the notarization of Chinese embassies and consulates abroad, the Chinese embassies and consulates in Germany uniformly published the Notice on the Handling of Relevant Notarization on their website, and the instructions and templates for handling the power of attorney involving the disposal of property were then "removed". Some applicants who intend to entrust their family members to handle domestic property sales "panic": "Why don't they do it again?" "What if they don't have time to go back to China?" "Won't we just notarize a signature?" Over the past two years, we have received many relevant inquiries. What is the truth? Please listen to me:

   Why not notarize the property involved in disposal?

In August 2017, the Ministry of Justice issued the Notice on the "Five Prohibitions" of Notary Practice, requiring applicants to submit the original copies of property certificate or property ownership certificate, identity certificate, marital relationship certificate and other materials when applying for notarization involving the disposal of real estate or other major property. In accordance with the principle of authenticity and legality established in the Notarization Law of the People's Republic of China, embassies and consulates stationed abroad, as state organs exercising notarial functions, shall review and verify the authenticity of relevant materials. Since embassies and consulates abroad do not have the conditions for substantive examination of the above materials, the above notarization will not be carried out in principle since September 2017. Notarization of corporate affairs involving equity transactions, loans, and the exercise of shareholders' voting rights will not be handled according to the above principles.

   Why am I criticized when my friends succeed? Is there any "mystery" in it?

There is no mystery, but there is a solution, which is hidden in the "Notice on Handling the Relevant Notarization". The Notice said that if the applicant insists on handling the notarization related to the disposal of real estate or other major property, the library will review and accept the application, It will be added in the notarial words: "This notarial certificate only proves the authenticity of the signature, fingerprint or seal on the attached document, and does not prove the authenticity of the ID card, house property certificate and other property ownership certificates mentioned in the document, nor does it prove that the document applicant has the right to dispose of the property mentioned in the document." The applicant must provide relevant supporting materials (such as property ownership certificate), And follow the principle of "one commission for each major event". If you are considering handling property related matters, please read the Notice carefully.

   Is there any other method besides going to the Consulate General to apply for notarization of the property involved in disposal in person?

The applicant can also apply for consular authentication at the Consulate General after completing the authentication of the German Federal Administration. You do not need to come to the consulate in person to handle consular certification. You can also entrust others to do it without making an appointment in advance.
