Article 1 To protect normal religious activities , Maintenance Religion At the venue Legal rights and interests These Regulations are formulated in accordance with the Constitution to facilitate the administration of places for religious activities.
Article 2 The place for religious activities mentioned in these Regulations refers to the place where religious activities are carried out religious activities Of temple Palace mosque church And other fixed places.
The establishment of places for religious activities must be registered. The registration measures shall be formulated by the religious affairs department of the State Council.
Article 3 Sites for religious activities shall be managed independently by the management organizations of the sites. Their legitimate rights and interests and the normal religious activities in the sites shall be protected by law. No organization or individual may infringe upon or interfere with them.
Article 4 A management system shall be established for places of religious activities. When conducting religious activities in places for religious activities, laws and regulations shall be observed. No one may use places for religious activities to engage in activities that undermine national unity, national unity, public security, harm citizens' health, or interfere with the educational system of the State.
Sites for religious activities shall not be subject to the control of overseas organizations and individuals.
Article 5 Permanent residents and foreign temporary residents of places for religious activities shall abide by the provisions of the State on household registration administration.
Article 6 Places for religious activities can accept donations, contributions and stickers from believers.
Places for religious activities that accept donations from religious organizations and individuals abroad shall be handled in accordance with the relevant provisions of the State.
Article 7 In places for religious activities, organizations for the administration of places for religious activities may, in accordance with the relevant provisions of the State, operate and sell religious articles, religious works of art and religious books and periodicals.
Article 8 The property and income of a place for religious activities shall be managed and used by the management organization of the place, and no other unit or individual may possess or transfer them for free.
Article 9 Where a place for religious activities is terminated or merged, it shall be filed with the original registration authority, and its property shall be disposed of in accordance with the relevant provisions of the State.
Article 10 For the land, mountains, forests, houses, etc. managed and used by places for religious activities, the management organization of the places or the religious organizations to which they belong shall obtain certificates in accordance with the relevant provisions of the State.
The requisition of land, forests, houses, etc. managed and used by the State for religious activities shall be handled in accordance with the Land Administration Law of the People's Republic of China and other relevant regulations of the State.
Article 11 The units and individuals concerned must obtain the consent of the administrative organization of the places for religious activities and the religious affairs department of the people's government at or above the county level before going to the relevant departments to go through the formalities for rebuilding or building new buildings, setting up commercial and service outlets, or holding exhibitions, films and television films and other activities within the scope of administration of places for religious activities.
Article 12 Listed as Cultural relics protection unit Or in Scenic Attraction Sites for religious activities within the city shall, in accordance with the provisions of relevant laws and regulations, manage and protect cultural relics and the environment, and accept the guidance and supervision of the relevant departments.
Article 13 The religious affairs departments of the people's governments at or above the county level shall guide and supervise the implementation of these Regulations.
Article 14 Where a place for religious activities violates the provisions of these Regulations, the religious affairs department of the people's government at or above the county level may, according to the seriousness of the case, give it a warning, suspend its activities, or revoke its registration; If the circumstances are especially serious, the people's government at the same level shall be requested to ban it according to law.
Article 15 Those who violate the provisions of these Regulations and constitute acts violating the administration of public security shall be punished by the public security organ in accordance with the relevant provisions of the Regulations of the People's Republic of China on Administrative Penalties for Public Security; If a crime is constituted, the judicial organ shall investigate the criminal responsibility according to law.
Article 16 If the party concerned is not satisfied with the administrative decision, it may apply for administrative reconsideration or bring an administrative lawsuit in accordance with the provisions of relevant laws and regulations.
Article 17 If the religious affairs department of the people's government at or above the county level requests the people's government at the same level to order the violator to stop the infringing activities in violation of the provisions of these Regulations and infringes upon the legitimate rights and interests of places for religious activities, and if economic losses are caused, compensation shall be made according to law.
Article 18 The people's governments of provinces, autonomous regions and municipalities directly under the Central Government may, in accordance with these Regulations and in the light of their local actual conditions, formulate implementation measures.
Article 19 These Regulations shall be interpreted by the religious affairs department of the State Council.
Article 20 These Regulations shall come into force as of the date of promulgation. [1]
