Previously, the defendants Zhang and Li had been sentenced to fixed-term imprisonment by the court for committing theft. Unexpectedly, after their release from prison, they "resumed their business" again. During the period from December 2023 to January 2024, the defendants Zhang, Li and Yang (to be dealt with separately) committed theft in Xin'an Village, Xiayang Village, Haicang District, Xiamen City by covering the WeChat collection QR code and Alipay collection QR code prepared in advance under Zhang's name on others' booth collection QR code, And use Li's mobile phone to log in to the above WeChat and Alipay accounts to collect stolen money, and the stolen money is used for daily expenses.
According to statistics, the defendants Zhang and Li stole more than 1700 yuan from the victims through the above methods.
On January 18, 2024, Mr. Zhang and Mr. Li were captured by the public security organ and truthfully confessed the above criminal facts after arriving at the case.
After hearing the case, Haicang Court held that the perpetrator had been subject to criminal punishment for theft, and if the amount of theft again exceeded 1500 yuan, it was considered that it reached the standard of "large amount". In this case, Mr. Zhang and Mr. Li secretly stole other people's property for the purpose of illegal possession, with a total amount of more than 1700 yuan, which is relatively large, and their acts have constituted theft.
