Since the policy of "two children alone" was launched in our province on May 30 last year, more and more "second child mothers" have faced such problems. To this end, many "second child mothers" and some deputies to the National People's Congress called for the extension of all maternity leave, including the second child maternity leave.

Experts said that the extra 60 days of maternity leave for the first child and late childbirth is a rewarding policy. Before China has fully liberalized the family planning policy, there may be many practical problems in comprehensively extending maternity leave.

  Trouble: The second child's maternity leave shrinks and the nursing work is delayed twice

"The baby hasn't been weaned yet. When he goes to work, he always thinks about the children at home, and his work can't be at ease." Cui Xiaoying (not her real name) hurries home every day after work, just to breastfeed the baby earlier. Cui Xiaoying, 33, works in a public institution in the provincial capital. It is reported that since May 30 last year, our province has officially implemented the policy of "two children alone", and the province has received more than 300000 applications for "two children alone" rebirth. "I'm trying to find a way to ask for leave again. If I can breast feed one more day, I can breast feed one more day." Ms. Sun, who is about to end her three-month maternity leave, is also a "second child mother". "I took nearly half a year's maternity leave for my first child.   Policy: 60 days late childbearing leave is a reward for the second child

According to the Special Regulations on Labor Protection of Female Employees issued by the State Council in 2012, female employees are entitled to 98 days of maternity leave, including 15 days of prenatal leave; dystocia 15 days of maternity leave will be added; For multiple births, 15 days of maternity leave will be added for each additional baby.

On the basis of national regulations, the Regulations on Population and Family Planning also stipulates that citizens who give birth late can be rewarded with extended maternity leave, which is specifically formulated by the people's congresses and their standing committees or people's governments of provinces, autonomous regions, cities and larger cities.

According to the Regulations of Shandong Province on Population and Family Planning, "If a woman gives birth late, in addition to the maternity leave stipulated by the state, 60 days of maternity leave will be added." Among them, "late childbirth" refers to "married women who have reached the age of 23 gestation Those who have the first child are late childbearing ". That is, giving birth to a second child does not belong to late childbirth, and the maternity leave is 98 days as stipulated by the country, and the man has no nursing leave.

Accordingly, the reporter calculated an account that mothers who meet the conditions for late childbirth can enjoy 60 days of late childbirth leave stipulated by our province in addition to 98 days of maternity leave stipulated by the state when giving birth to the first child. With dystocia and other conditions included, the maternity leave can reach 173 days, nearly half a year. For the second child, there are only 98 days. Even if the 15 day hard maternity leave is included, there are only 113 days, 60 days less late childbirth leave than that for the first child.

"Since the country allows the birth of a second child, why do they treat maternity leave differently?" With regard to the issue of differential treatment of two children for one child, Chen Xueping believes that it is best to unify all kinds of maternity leave, and women should be given the same maternity leave and the same maternity subsidies. There are similar situations of different maternity leave for one child and two children across the country, but now some provinces have begun to gradually unify. For example, the 2014 Liaoning Provincial Population and Family Planning Regulations (Amendment) stipulates that employees who meet the legal conditions to have a second child and have a late child can enjoy the policy of late childbearing leave (60 days more) and male nursing leave (15 days more) that was originally only given to married women who were pregnant and gave birth to the first child after they reached the age of 23, and that "wages will be paid as usual during the leave, and benefits will remain unchanged".

   Viewpoint: The number of maternity leave for the second child should be combined with the actual situation

"In some countries with a very low birth rate, people will use extra long paid maternity leave to attract people to give birth. The situation in China is different, but we need to rely on this incentive measure to guide family planning." As a medical expert, Sun Wei, a deputy to the National People's Congress and director of the Department of Reproductive Medicine of the Second Affiliated Hospital of Shandong University of Traditional Chinese Medicine, believes that if only from a physiological point of view, One year's maternity leave is the most beneficial to the health of mothers and babies, which is also true in some foreign practices. However, the actual amount of maternity leave in China should be combined with the actual situation in China.

"Some mothers don't have to take maternity leave even if you let her take it for half a year or one year." Sun Wei said that although the law stipulates that maternity leave should be paid, in some units, salary accounts for a small proportion of the salary structure, and more is the bonus. "And if you take it for half a year or one year, your original position may be lost." The granddaughter who worked in a private enterprise started to work before she gave birth.

"If you don't work, you can only get a salary of more than 1000 yuan. What's more, it may delay your promotion." Ms. Sun said a lot about her second child mother.

"It's unfair for our employers to take so many maternity leave." A person in charge of a tourism enterprise said that if one child takes half a year off with pay and the second child takes half a year off with pay, "our burden will be too heavy." In the opinion of Sun Wei and other experts, the problem of extending and unifying maternity leave can only be solved in order according to the actual situation.
